sir,
one of my family member took a loan in the yr 2005 from a private bank mortgaging the property paper of a house which is in the name of my grandmother who expired in the yr 1999 by misrepresenting someother lady as my grandmother and after 2 yrs my grandfather got a recall notice on her name n my grandfather was very shocked about it and gave a notice to them giving the information of the death of my grand mother and also requesting them to furnish the information and documents regarding the said loan under RTI act but the bank denied to give any information regarding the said loan stating its not governed by RTI act
by basic question is can a private sector bank deny furnishing the information and documents of the said loan stating its not governed by RTI act

Private sector bank does not come under the purview of RTI Act. You can nevertheless lodge complainant for fraud and cheating against culprits.

Mr. Barman has given valuable advise.Kindly follow it.
Following are some important documents provided by banks:
· letter of offer
· copy of filled in loan application
· copy of loan agreement
· terms and conditions governing the housing loan
· other documents such as schedule of fees and charges
Banks are required to give authenticated copies of documents executed by you free of charge. (cf. para 8.11.1 of Code of bank’s Commitment to Customers)
You can also ask which bank official had visited the borrower, verified the documents, credentials, and to whom and how loan disbursement was made and on which dates.
