Marriage registration

Sir.
I am a keralite boy wanted to marry my croatian girlfriend in India under special marriage act or HIindu marriage act in Delhi or in Goa. She has visa for few days. Before she goes we need marriage certificate and the apostille stamp on it. Is it posssible to marry in legal office without many weeks of waitting Is ther any possible way to marry soon..and certificate should be valid both in India and Croatia also. hoping for a positive reply.

The marriage can be registered under Foreign Marriage Registration Act which is governed by Special Marriage Act.

Yes, it can be registered under SMA, which is valid throughout world.

There is no shortcut procedure, notice under special marriage act need to be served and registration of marriage has to be done as per procedure.

You can marry a foreigner in India only under the Foreigner Marriage Act, 1969 & neither under the Special Marriage Act, 1954 nor The Hindu Marriage Act, 1955 which applies to only the Indian citizens.

All marriages solemnized under the aforesaid Act are registered marriages before the Marriage officer/registrar where the Indian Spouse usually resides, on the fulfillment of various conditions such age, matrimonial status, mental status, relationship between the parties etc. A months notice for such marriage is issued after you file application for such an intended marriage, a copy of which is affixed outside the marriage office & a second is sent to the country where the other party resides.
On expire of one month, the parties to the marriage are married in presence of 3 adult witnesses if no objection is received by the marriage officer & a certificate is issued regarding this marriage.
Indian can marry any foreigner only under the Foreign Marriage Act, 1969 where the bride-groom has to be at least 21years old.

Legally getting married in India as a foreigner is a lengthy and time consuming process. one should be prepared to spend around 60 days in India. Here are the basic legal requirements for getting married in India by foreigner.

In India, civil weddings are governed by the provisions of The Special Marriage Act (1954). There’s a 30 day residency requirement, which means that either the bride or the groom has to be living in India for at least 30 days prior to applying to the local registry office to get married. For foreigners, this is evidenced by a certificate from the local police station.

You’ll need to submit your intention to get married to the registry office, along with evidence of residency, certified copies of passports and birth certificates, and two passport sized photographs each. It's only necessary for one of the parties, not both, to be present to submit the intention to marry.

In addition, evidence of eligibility to be married is usually required. Anyone who hasn’t been married should obtain a single status affidavit (in the US), a Certificate of No Impediment (in the UK), or Certificate of No Record (in Australia). If you’re divorced, you’ll need to produce the Decree Absolute, or if you’re widowed, a copy of the death certificate.

If no objections to the marriage are received within 30 days of the application, a civil ceremony at the registry office can then take place. Three witnesses are required, who have to provide passport sized photographs, as well as identification and proof of address. The marriage certificate is usually issued a couple of weeks after the wedding.
