This is Karthick and I have question on my grandfather's ancestral property. I have mother, father and brother, my wife and my childrens in my family. My Grandfather and my grandmother died and property is distributed to all his successors. My father got his share and it is currently in his name and he is taking care of income. The issue is my father is not taking care of my brother and mother for basic neccessities and also both are having health issues. I take care of most of the time but I also have lot of responsibilities of taking care of my wife and childrens. My father is now not at all taking any responsibility at home and take all the income from ancestor property.
We would like to know that can we claim the income of the ancestral property for my mother and brother for thier basic necessities ans health care?? Kindly clarify so that we can think of putting the case...
We also know that my father cannot sell the property without our permission...Is that true????

Dear Karthik,
You have to tell as to how your grandfather got the property? - whether self-acquired it or he got it from his father/grandfather?
If he got it from his father/grand father - in which he got it.

Hello Anirudh Sir,
I am not Sure whether it is my grandfather's self-aquired or got from his father but Please let me know what law will apply if property is my grandfather's self-acquired and also for in case if it is his ancestral property.

if the property is in your fathers name then he has all rights over it he can use it as he wish , he has absolute right to take income from that property, if he is not taking care of your mother then your mother can get maintenance for herself after filing crpc 125 in the court.

consult a local lawyer and show him all the papers and the status of property.
Amicable understanding with the help of nears and dears is better.
