forged signatures in account opening form

(Querist) 24 August 2014 This query is : Resolved
I opened an account with a share broking company (ventura securities) an year back. I found some unauthorized transactions in it. On enquiring I was given a scan copy of my account opening form. I never filled or signed the form. Signatures were forged in it. How should proceed legally against them?

file police complaint of cheating , forgery against broking firm . inform the firm that no such account has been opened by you . copy of said letter should be addressed to SEBI

You had opened an a/c with firm an year back.

How can the firm open an account without you signing the account opening form?

However if the signature have been forged then you have a case even if you were allowed to transact without signing a/c opening form.

You can lodge a police complaint for forgery and losses if any u/s 406 ipc.

You are most welcome.

You say that you opened an account with a share broking company (ventura securities) an year back.

You say that you found some unauthorized transactions in it.

If that be the case, then what you would be suspecting is the instructions based on which the transactions were done in your account and NOT who opened the account.

If your query is on whose instructions the transaction in question were done, the stock broker has to indicate the particulars.

Therefore the question of the broker showing the scan copy of the account opening form to my mind does not appeal.

EITHER YOU ARE CONFUSED OR NOT REVEALING THE CORRECT FACT SITUATION.
vallimanalan (Querist) 31 August 2014
Anirudh sir the broker is yet to give me a reply about the unauthorized transaction. But while enquiring about it I came to know that I was charged doubly by them for trading. They said all information about charges were in the application form which I had submitted. So I requested for a scan copy of application form. The form they had sent was completely different from what I had submitted and my signatures were forged in it.

IF YOU ARE SURE THAT THE SIGNATURES ARE FORGED, THEN MAKE A COMPLAINT TO NSE or BSE (as the case may be) AND to SEBI.
Kumar Doab (Expert) 31 August 2014
Did you keep a duly receipted copy of the form submitted by you. If yes it is much better.

As advised by the experts if your signature have been forged lodge a complaint.
Raj Kumar Makkad (Expert) 31 August 2014
Even complaint to the police can also be given in the given facts.
