Harassment by fatherin law-sr citizen

(Querist) 11 April 2016 This query is : Resolved
Dear expert,
My father in law is more than about 80 year old and he is a pervert. He tried many times on me and thereafter my refusal and after I told my husband (his son) and my hubby's sister, I am not on talking terms with him.
After the episode, last few years he has been continuously harassing the maids and other females who come to my house. Past he has become more aggressive and creates lot of problems for me and my husband. Most of the relatives know about him and his pervertness.

Now, me and his son (my husband) stay in the house which is in my father in law's name. He is now wanting us to to leave the house so that he can enjoy his life. I have been married for over 11 years now, and it is because of my father in law there is mental trauma and stress. I even developed a disease and it took me over 10-12 months to overcome that disease.
I am feeling traumatised and harassed at all times.
Please advise me, what should I do,
a) I dont want to leave my father in law's house, as I have a doubt he can get involved with some female who can dupe/cheat him.
b) I dont want to leave my husband as he loves me a lot.
c) Do I have any legal right to stay in the house, I have nurtured the house for over 10 years. My soul is in this house.
d) I have the voice recording of my father in law admission of having harassing women and I also have it in written where in he says sorry for his mistakes.
Please advise me, I feel very helpless and depressed.
Regards
Sonia

For the harassment and mental trauma you can lodge complain against your father in law on which basis the criminal case can be initiated against him, which may however jeopardise your relation with your husband.
AS per as the house is concern neither you nor your husband has got any share in it and hence your FIL can rightfully ask you to leave the same ad later transfer it to any one he chooses.

House is in the name of your FIL, he can ask you to leave.

Better change your residence it would be in the interest of all.

Thanks. Mr. Devjyoti, Mr Goyal & Mr Narula. Is there any claim I can make on the up-keepment of house for over 10 years. I have spent almost every penny of my salary and have undertaken massive renovation 3 years back. My husband and my Nanad has been with me all this while. Will it help in case my husband keep the original papers with him on the pretext of either converting into freehold property. Can my husband also transfer the property in his name as currently the property is in leasehold. My life has been ruined, I just dont want to leave this house.

i am Mr.Nanda and not Narula as stated by you.

If you are forced to leave the house which is your matrimonial home the you can take recourse to DV Act.

Ask him to bring court order for eviction and be cool.

In case he tries to sexually harass you then deal the way you could deal with a street hooligan.

Your husband can transfer property in his name with NOC from all brothers and sisters but you will have to wait for death of your FIL.
