How to take possession of tenanted property. tenant died and has no legal heirs

sir
i am landlord. property situated at mumbai. tenant died. tenant has no legal heirs. room is locked. please guide how to take possession of tenanted property as per law.

you may published an information in local newspaper regarding the death of your tenant and mention there validity of claim upon the movable property along with claim of tenancy right upon the said dwelling room. After the expiry of date you may open the door in presence of witnesses and take possession of said room.

While I agree with the views of experts, can the local police be informed about the death with death certificate to break open the door and take possession being the property owner and hand over the movable property if any to policy for proper verification and handing over to any claimant as admissible under law?

It is unnecessary to involve police in this matter, if there is chance of doubtful matter arise then for self defense owner may be involve police.

I do not find anything wrong in taking the help of local police. However if some relative at a later point of time complaint against the owner for breaking open the premises what is the remedy open for the owner lawfully.

You can complain before the local police or in the alternative you may go to court. You cannot take possession by yourself. Later, if any legal heir of the deceased comes and disputes the matter that there were some valuables left in the room, it will be a problem.

Police has got No Powers to break open any House unless and until there is some Emergency like Fire Or suicide attempt or Suspicious grounds etc.Court would be the Perfect Legal Remedy and in yours case could be mostly completed in 3 months as it would be Ex Party as per your statement and an News Paper advt regarding this would be mandatory in Court.Consult A Local Good Senior Advocate.
