Marriage annulment

Dear sir/madam,

Wife filed annulment of marriage under various provisions of HMA. Later husband discored fraud and also wants to annul the marriage.

Should the husband file a seperate petition for annulmet or can he file additional counter to the wife's petition stating the facts and praying for the same relief as that of wife but on the ground that wife committed fraud.

please clarify.

Dear Anonymous,
Merely there is similarly of object i.e. annulment of marriage does not mean that the husband should admit the contents of wife's petition. In the fitness of circumstances he should file a separate petition and contest wife's allegations.

Since the wife has already filed a suit for annulment of marriage the husband can also claim such relief in his written statement stating the grounds and he need not file a separate petition.
