hello my friends,
pl.help me in my problem.
I filed discharge application in one regular criminal case of ipc 409.
but it is filled after framing charge, in the light of one importent citation, because my vakalatnama filled after charge.
but trial court rejected the same with imposing cost of rs. 5000/-
then i filled revision to condone cost rs. 5000/- but revisional DJ court dismiss the revision by explaning that this is an interlocutary order.
now what can i take proper step to condone cost rs. 5000/- pl. help.

non use as it would not be reversed you could have asked for reduction as an alternate remedy but that stage has also gone now.

It was not aninterlocutory order. Challenge the order of the sessions court before the high court u/s 482 crpc. However the discharge applicaton is unlikely to be allowed for hearing but you could try your luck to reduce or nullify the cost.
