hi, can you please let me know if we can nominate any friend/relative of ours to attend court in our place(other than my lawyer filing petition) if i am moving out of state/country during court attending dates. whats the procedure ?

IN CASE OF CIVIL SUIT YOU MAY GIVE POWER OF ATTORNEY TO OTHER PERSON. BUT IN CRIMINAL CASES IN CASE YOU ARE ACCUSED THEN YOU HAVE TO APPLY FOR EXEMPTION FROM THE COURT.UNLESS EXEMPTION IS GRANTED ,AND YOU REMAIN ABSENT THEN WARRANT WILL BE ISSUED BY THE COURT.SO BE CAREFUL AND MENTION EXACT DETAILS FOR HELP.GOOD LUCK.

Yes,for civil cases,you may give power of attorney to anyone and authorised him to attend the court but in criminal case you have to seek exemption to attend court.

If you are a girl and the complainant, then you will be entertained to be represented by anyone both in Civil and Criminal Cases. If you are a boy and an accused, then exemption is the only key in criminal cases but in civil cases, no problem.

The procedure for the criminal court and civil court are different. So, for getting a prompt reply state whether it is a civil or criminal case.

mine is a criminal case under section 292D .
1)can i get exempt from court attending surely
2)what should i do to file for court exemption

There are limitation for POA even in civil cases.POA can not replace advocate.
