business commission

(Querist) 08 April 2011 This query is : Resolved 
Dear Sir,

I have made one overseas shipment on commission basis,suppliers has recd 100% advance payment from buyer, now two months over and supplier is not releasing my commission.

I have written confirmation of supplier stating that commission will be released after receipt of 100% payment.

I request to you please advice me how i will get my commission.

you can file recover of money suit claiming amount of commission.

You may send a lawyer notice to the supplier, requesting for the payment of agreed commission, within a specified period. If he did not comply, your remedy is to file suit against the supplier, with prayer for Order for commission and interest and costs.

While I completely agree with the views of the experts, still I feel that you should pursue with the seller for your commission. It seems that such delaying tactics are common in such field. I think you should also have an eye on the future such opportunities, which may get adversely affected if you indulge in any legal action at this stage. Keep all things in view and then decide. (I am not suggesting not to take action, but only to have little patience in realising your commission amount.)
