Whther action against bank is maintainable?

Guest (Querist) 25 July 2011 This query is : Resolved
Respected Sir,
I have filed the RTI application at Bank (PSU) sseking the information on general queries such as defreezing of account etc and asking about the procedure for the infromation only
The cpio didn't reply and then move to appellate autority he to didnot reply
Then I move to Central Information Commission (CIC) where the Hon'ble commission had direction for show for cause notice and penalty provison as per sted in the bank
I received the reply on tyhe general query and in the last para
the bank has delibrately add very odd words which are pretaining to dispute of my brother and my sister in law and alleged that my sister in law and her father has made complaint against me and my father and my brother that we are attempting to withdraw the money from the joint bank A/C which she has opened with my brother(her wife) and also written that I had been subjected her to cruelty, mental toture and insult by emotional, physical, economic etc etc..

I get shocked to hear about this how the bank has malign my reputataion by providing information in this way which has nothing to do with my queries asked
I don't understand why the bank has added such lines in its reply under RTI act

It seems that bank has enquired my whereabouts and had supplied information in this manner

Even some one has complaint against me (may be by the inducement of bank), I have nothing to do with her complaint
Why they are spilling the salt on my wound

I get very much depressed on reading all the contents as I myself don't know about the whereabouts of her A/C and such kind of langauage must have been prohibited by bank

Kindly inform whether any civil suit in regards to this is mainataiable??

I have asked only the general queries pertaining to the deffrezing of account and its reactivation without concerned of any account. The queries are very general in nature seeking information only without any interest
The CPIO & Appelate Authority didn't reveal Finally I appraoched to CIC where it has been directed why should not be imposed on CPIO . The CPIO repled to my queries and in one para it has revaeled that THEY HAD RECEIVED COMPLAINT FROM MY SISTER IN LAW AND HER FATHER That I , MY FATHER AND MY BEOTHER(Who is husband) has trying to withdrwa the money from her joint A/C which my brother had opened with her and has also alleged that I, MY FATHER AND MY BROTHER has subjected to her insults, mental torture and harassing her by Physical, emotional, economical et etc

She has the dispute with my brother so if she should only named only pertaining for security
Why my name and my father has been dragged on this when we have no concerned about their money?
Apart from this why she has falsely alleged that I and my father has been causing cruelty, mental hassemnt ete etc to her?
Apart from this why her father has made complaint and drageed my name in this?
Apart from above all,
Why the bank took very much interest in making personal comments that she has filed the complaint and we rea taken action on merits as CPIO is only bounded to provide the relevant information pertaining to my general queries which are menat for genral public only
It clrarly shows that CPIO has vderified my location and whereabouts and took interest in this ?

My reputation and my father father reputation has been harmed from both sides without any fault?

Kindly give remarks on this

Any reply under RTI Act either given by CPIO, AA or CIC should confine to the information sought in the application. Undoubtedly Bank has exceeded this and castigated doubtful remarks on the applicant. You can take up the matter with CIC by forwarding the reply received and ask CIC to take action against the Bank. This is one channel. The other is yes, you can initiate legal action against the Bank for its malicious comments included in the reply to your RTI application. The learned members of this club will guide you whether it comes under defamation or not.
