Pay protection

Dear Sirs,
I am working as Jr. Engineer in pay scale of 9300 - 34800/- in Employees' State Insurance Corporation. I have joined ESIC in June 2011. Before this i worked as Jr. Engineer in NHPC Ltd. for about 7 years in Pay scale of 13500-39500 with last basic pay 23500/-. I have changed my job from NHPC to ESIC after doing all formatlities. I want to know whether Pay Protection is applicable in my case.

Pay protection does not apply in the case of transfer of an employee from a higher scale of pay to a lower scale of pay unless the new post is specifically declared as the post involving higher responsibility than the previous post. Your pay can be fixed at the stage equivalent to your basic pay, if that exists in the new pay scale. Otherwise the same can be fixed at the lower stage of pay with grant of personal pay (PP) to bring you at par with the earlier basic pay, where the PP would get absorbed in your future increment or increments in the new scale of pay.

I want to know whether my last basic+DA of NHPC will be fixed in ESIC. Also whether my service period of NHPC will count in ESIC.

Why type of pre-appointment formalities did you do before selection against the post in ESIC.
