Property dispute

(Querist) 13 June 2012 This query is : Resolved 
My father owned a shop. My father died 2004. My step mother & my step sister gives no objection certificate after died of my father. This certificate wrote in Rs. 100 stump paper & notary. In this base we want transfer shop our name before we transfer a shop my mother will suit case now she need her share. Registration officers registration shop our name with condition finally court judgment you agree and finally judgment not come till you can’t sales,loan,morgages.

1. Step Mother is entitled to property notwithstanding the NoC - a registered reqlinquishment is required, and nothing less would do.

2. Since the NoC is not effective, Step mother is entitled to equal share of the property with you.

3. It seems there is a stay on the property.

4. Defend the suit filed by step mom diligently.
