Construction issue

(Querist) 21 December 2012 This query is : Resolved
Hi,
We had ancestral property which my father wanted to sell and construct in a new layout, which is in his name.
We are 2 brothers aged 40 & 45.While selling old property he promised us that ,we can also construct a portion if we want to.Now construction is 40% done, when I approch him now he says we should not do it.
I want to stop his contruction inbetween so that he allows us to construct.
What can be done please help, we stay in rented house.

For any dispute regarding demarcation and possession of joint property you can always go to civil court, file a suit for partition and injunction.

As the ancestral property has already been sold and construction is being made on new property exclusively purchased in the name of your father so legally you have no right to intervene in this property but you can definitely challenge the earlier sale made by you father by filing s civil suit seeking setting aside of that property as the same was an ancestral in which you had also a share.

It shall be better to serve a legal notice to you father and the buyer in this regard.
