Illegal construction

Respected Sir/Madam

I am living at Kalkaji Double Storey Quaters, alloted to my father by l&do at ground floor, my father Expired in 2011, the person residing above our house had constructed 2nd floor illegally in 1995 & in 2011 he constructed 2nd floor also, my father when he is alive in August 2011 made a complaint at 100 No. once when he making 2nd floor they stopped for few days but again after few days they complete the construction.

Now, Due to load )2nd Floor) our lanter on ground floor craked from the centre and walls has also craked, because govt. alloted these houses for refugeesin 1952 after partition of India/Pakistan and govt. not aware that people construct more stories on these buildings. Now we one ground floor afraid if building destoray in future. I write on Delhi Govt. Site "AAP KI SUNWAI" and after 10 days two people from MCD Depptt. Came to our house and my mother shows them craked lanter. Next day when I checked the status of my complaint they mentioned that we checked the site and at present there is no construction going on the site.

Sir, will you please help me what should I do or where I can make the compaint for the same or can I file a suit for the same illegal construction.

since MCD is not taking action move court and obtain an order directing your neighbour to demolish 2nd floor . in the alternative submit plans duly sanctioned by MCD

you can also file RTI application and find out whether plans sanctioned by MCD

You require to file a civil suit seeking demolition of the illegal construction showing the status of yor house to a local commission duly appointed by the court. Involve MCD in this case and for that purpose, you need to isse a legal notice.

Engage a lawyer immediately and do as per his advice.
