Thanks for taking out time for reading my query. I want to marry this guy. His divorce case was pending. However, now the settlement agreement has been signed by the parties at the Mediation centre and money has been given by him to his wife as well. The case was listed for hearing on Dec 18. However, due to big cause list the hearing did not happen. Now the case is listed for hearing tomorrow. How much time does the court take to pass the order once settlement is done at mediation centre. Also, do the parties need to be present at the court or lawyers of both the parties can handle it?

It is not possible to comment without seeing the petition and court's order,however if the suit is filed as Divorce on Mutual consent or switchover to mutual consent then the both parties have to be present before the court and it is one time and final hearing.

Settlement shall follow MCD which shall take at least 6 months and both parties shall be required to attend the court on those hearings.

Once settled, and if matter is pending in court for over 6 months, same day order will be passed. No need to wait another 6 months. Case will be convert to mcd.
Parties reqd to be present and file their Affidavit.

Shroff! The period of 6 months waiting period can be condoned only by supreme court and not any other lower court.
