One of my relative had signed up in a blank promissory note (just two 1re revenue stamp stuck on it) for getting money on a emergency purpose from one of his friend. Is it possible for that friend to file in a legal suit against my relative. How much amount that friend can claim using that promissory note(He got Rs 5000).
Note: No witness signature; No date; No amount filled in.

cross the bridge when you come to it . as on date the blank note has not been filled in . why did you sign blank note when you took a loan of only Rs 5,000 . send a letter to him recording aforesaid facts that blank p note has been given by you for Es 5000.

A suit for recover can definitely be filed by that friend in whose favour such promissiory note has been executed. The date can be got filled by him.

You have given a weapon to the other side. Now you have to come out of the battle. Your case is weak. He will definitely file a money recovery case. By appointing a good experienced lawyer, you can disprove the case. But the chances are only 50%.
