Competition commission

(Querist) 26 December 2013 This query is : Resolved
Dear All,

I am supposed to acquire a shop space on lease for footwear business. In the lease Deed I want to put a clause whereby the landlord shall be restrained to offer any space within the premises to an entity who is engaged in similar trade. Please give your kind advice to the clause , will that amount to violation of any provision of Competition Commission laws.
Devajyoti Barman (Expert) 26 December 2013
Such clause would not violate competition act.
However the landlord is unlikely to put such clause especially if the premises is a big one.
Has this been so then no shopping would have multiple shops of various brands of same product.

You may go ahead if landlord agree to it.
