Person with civil case is dead

my father was a society chairman the fraud of some money was done by secretary,the civil case was filed against my father. now my father is dead then what about the case against him? How do i recover the property books which are in the court,please help me out.. please sir the whole family will be on roads help me out

THE REGISTRAR CAN RECOVER THE DEFICIT AMOUNT:
Fraud with member's money by Mg committee of Society is breach of trust, and recoverable by attachment and sale of The Flat.

It will teach lesson to thousands of other chairman/ secretary, to be honest..

You eat and feeded by such dirty money, so need to vomit it out..

i personally believe, ALL CRIMINALS MUST BE PUNISHED, LET FEW INNOCENT TO SACRIFICE FOR TO MEET THE END OF JUSTICE.

Society will improve by doing so.

It cannot be anti-social.

Wht aquit 100's of criminal, to save one innocent???
It will increase crimes.

Let 101 be punished, and 1 innocent is sacrificed, to reduce crimes.

It will reduce corruption, violence, clean the Society, bring back : niti, dharam. peace, no theft, no fear,
Probably no court and no lawyers!!!..
It is desirable to punish all wrong doers at any cost. People should not dare doing wrong.......

This is my personal opinion, Not to save, not to help crime/ or criminals..

If you have the interest of the properties which are lying in the court, you can implead yourself as party to the case and expediate the matter.

Do you want to recover the property book or property itself? Implead yourself as LR of deceased, contest the case and recover the same if you have merits on your side.

the property books are my land papers are taken during the filing of case against my father ,now he is no more sir he is dead can the civil case be dissmissed and the papers given back please tell me which procedures should i follow sir help me please

make an application for impleading yourself as party on death of your father . contact a local lawyer . only on completion of case will you get the papers

If the case is disposed of then you can apply for its release from case record.

The one who filed the case against your father is under legal duty to add you as party.Unless court dismisses the case against your father,you can not get the property papers back as it seems to be case of attachment before judgement.You have not stated facts properly.

your property papers establish your constitutional right to property, which courts have upheld in our country.
so ask your lawyer to file a case to protect your constitutional right to property.matters will be expedited as infringement of constitutional rights will be viewed seriously and dealt on priority.
