Dear sir,
I am loooking flat in pune but property tax is not on bulider name its on her friends name can bulider sell same property to 2 person builder is tilling that he has not done the aggrement for same flat .
1.How is the name transfered to the property tax without making aggrement.
2.Can the bulider change the name of this friend after my aggrement .

First disclose why his friend's name is there.
If he is erstwhile owner then nothing to worry as even after sale it takes some time to make changes in property tax register.

Find out the conditions under which his friends name existed in the records. If facts found satisfactory you may proceed.

If builder is not owner, holder of any rights to sell then he can't enter into any sale agreement of the Flat.

Consult a local lawyer and let your lawyer advice you if the title is clear on not.

Until then don't sign any document and don't pay.

I agree with advice of expert Shri Kumar Doab. Find out why the property tax registered a third person's name in their records. If that person later sold it to the builder, if there is a registered sale deed, property tax matter is not that serious as it would take some time to get the records changed. Hence, you have to make thorough enquiry before entering into any sale agreement.

First of all verify the title of the property whether it vest on the builder or somebody else. If you cannot ascertain, take the help of a local lawyer, take his opinion, if need be take a second opinion from another lawyer, confirm the details, ascertain the title of the vendor and if found to be genuine, proceed with the purchase.
