My elder sister married to a person who has promised my sister that he has applied for divorce to his earlier wife to make her agree for the marriage in a temple.
2 years have past but till date he has not divorced to his earlier wife and even started living with his earlier wife and started ignoring my sister.
He is so clever that before marriage he prepared my sister to sign on a paper where it is written that "he is marrying to my sister as they both want it but has not yet divorced to his earlier wife".
What can we do now against him?

file case of bigamy against him . he cannot remarry during subsistence of earlier marriage . or file DV case , seek right to stay in matrimonial home , maintenance

Agreement is VOID AB-INITIO.
Your sister can lodge Police complain, file DV, for residence,mtn, damages etc.

Agree with the experts that your sister is having a good case in her favor. She should file criminal, maintenance, right to reside in matrimonial house, and other cases. She would not get her due if she do not fight.

she agree to live with him without lawful marriage?

uNFORTUNATELY YOUR SISTER IS NOT A MARRIED WIFE OF THE PERSON AND SHE HAS NO LEGAL STATUS.
However she can file case of bigamy or even 498A against him.

the marriage is void ab-initio, your sister cannot claim legally wedded status. However he can be punished for bigamy and other matrimonial offences, but what is your sister's stand?, she seems to have voluntarily consented for this illegal marriage, face the music.
