Hello,
I am Pravar Kulkarni, a finance professional. I met an accident last week, I was driving my friend's XUV, and I hit a swift desire from the back, totally my fault and I admitted my fault in front of all the onlookers. Luckily nobody was harmed, me and my friend promised to pay for the other driver's losses and gave him our card and went away. Nobody noted my license no. but they took the car's photo with me seating on the driver seat.
Now, yesterday the other driver called and said that we need to pay 15K to him which is the bill after the insurance amount he got, I am willing to pay that amount on my own, it's not a big amount for me.
However, my friend whose car I was driving is not ready to get it done so easily, just because there were some abusive words used by the other party at that accident scene, so my egoistic friend told the other party that he should go to court and we will get bail from the court at just 5k, so why should we pay him thrice.
I think we don't stand a chance against the person, because no where, it was his fault.
So, I am in a tricky position here, I told my friend not to get it further and just make peace with the other party by paying the due money, now we are waiting for the other party's reply. Now I need to have advice on following points:
1) Since the car is not mine I was just driving, the case will be registered against me or not?
2) What if the other party feels humiliated by my friend's 5k offer and decides to go to court anyhow and teach him a lesson?
3)Where do I stand in all this, as I just want to get it finished asap without my name dragged to the court?
Anybody please advice me on this.

right?
as a driver of the vehicle you only liable to be charge. if it is so the offence is duly bailable one. police can be registered under section 279 and 337 ipc alone.
usually there will be fine impose only as punishment. you wont be sent to prison.

but since as of your statement 15000 rs is not issue to you,my advise to go for amicable settlement with the other party.
dont take my first reply as advantage in any manner. cos how ever some one was suffered due to your rash and negligent driving.
so just drop ego. go for settlement.

Thanks Mr. Thangapandian, I would definitely talk about this with the other party on my own, apologize and pay him his due amount asap.

U should be happy that there are no causalities from either side.So the matter was not referred to the police,make sure about it.

Go for the amicable settlement, pay the repairing amount and get rid of the matter.

In all the probabilities the peaceful settlement of such a low amount would be a very great deal which if hesitated or negotiated or trying to evade, the problems will multiply and there may be unnecessary issues stretching to the expenses that may double or treble the amount now sought for by the other driver. Better dispose it amicably instead of getting misguided by your egoist friend's words.
