deceased due to careless treatment

My mother 51year old was admitted in NIMS hospital jaipur for heart bypass surgery on 23/10/2016. She deceased on 4/11/2016. I think doctor has neglected treatment. I think so because it may be their college students operated surgery. What should I do? I am so depressed because my mother was well before surgery. Please help

Sympathy for such heavy loss. Heart Surgery is major surgery and high risk factor is involved.

Hospitals can not take the risk of full operation by a student, even if chance is given, very senior experienced surgeon remain present and guide and take responsibility.

Before proceeding / admitting the patient, you should have inquired all factors including experience of surgeon.

Now get all documents checked from a well experienced heart surgeon, take his report in writing and if any negligence noted, may proceed.

Sorry to ask this Whether your mother's body was Cremated or Buried.If it is Buried it is Fine.Consult A Senior advocate and apply for fresh post mortem basing on your doubts and Simultaneously collect all hospital reports and Consult a Good Senior Doctor from your Place.

You should have lodge a complaint to the Police and file a case u/sec.304 IPC and demand for post mortem before cremation.

Now you can file a case in State Consumer Commission by claiming compensation. Generally doctors and Medical Council does not give opinion for the cause of death to save their colleague. So you can fight for justice with the help of lawyers.

Before filing complaint in consumer forum for the negligence of hospital and doctor and lodging FIR against them,consult with senior and expert doctor having experience in surgery with all the reports and documents,if said senior and expert doctor finds that there was negligence and mistakes in treatment and in operation,then proceed for legal action and not on presumption.

Cardiac Surgeon's job is all about precision.


There is no scope of error.

Error can be fatal.

Cardiac Surgery is performed by a cardiac Surgeon.


Error do happen.

Hope you have all documents: Pre- Admission, at admission, after operation.



It shall be better to consult before filing complaint.
