it depends upon the case. if it committed against two person one was killed and another is got severe injury then it come under attempt to murder.

murder happens when attempted but once the murder occurs attempt to murder does not attract as already murder has occured. So if murder does not occur then attempt to murder sections can be invoked.

agaist same attemt was made and in few days accused murdered him.i m asking this question from charge point of view.are both charges of same nature committed agaist same person within one year.sec 219 says if offence is punishable with same amount of imprinsoment.attempt to murder and murder r not punishble with same amount of imp.
