Power of attorney

(Querist) 10 January 2012 This query is : Resolved
For sale of ancestral property, is it permissible by law to give one POA in favor of 3 people by legal heirs.?

Also if one POA holder expires, then is the POA valid for the other 2 to use or it becomes null & void.?
Deepak Nair (Expert) 10 January 2012
for ancestral property, you can issue POA only with respect to your share.

If there are 3 attorneys, the power given to other 2 subsists even on death of one of the said 3 attorneis. it is valid for other 2.

1. POA can be given to as ,any person as you wish.
2. With the death of the principal, the agency comes to an end.
V R SHROFF (Expert) 10 January 2012
1. With the death of the principal, the POA end, becomes null & void for deceased person.
I suggest to get separate POA for all, so even on death of one f them, you may sign Agreement and keep ready to show, it was done during his lifetime.

After the death of the one person, you can get the POA from his legal heir.
Raj Kumar Makkad (Expert) 11 January 2012
I think your query has not property been understood.

Barman has properly replied your first query that as many as you wish can be appointed as your POA under one Deed but second query is still unresolved.

You may mention in the Deed of POA that one the death of either of POA, others shall have rights therein and this POA shall not expire in that condition and remaining POA holders may continue getting the same rights as if they were original appointed POA holders by testator.

Rightly advised by Ld. Mr. Makkad.
