Dear Sir(s),
A PIO of a City Corporation is delaying giving information about permission/sanctioned plan of a building which a person has already started building.
The PIO writes a letter on 1st appeal(30 days over) that "we are in the process of finding Information asked by you & as soon as we find the same it will be furnished to you (to the applicant).
Is this reply on 1st Appeal a valid one in RTI Act?
And if this is (writing letter by PIO)carried on in this manner how it is to be construed under the Act?
Please guide.. I 'll be thankful.

It is upto to you to wait. Or you can go for 2nd appeal without waiting.

The waiting period is a good reason for condoning delay in filing the second appeal.

You need not to wait for the information rather should file an appeal as the limitation to file appeal is going on day by day.

It seems that it is in connivance with the person who is building the alleged building, move 2nd Appeal ASAP and ask for early hearing.
