A complain case was registered before the magistrate against four accused persons. The names of first three accused person was correct but the name of the fourth accused was wrong though the father of the fourth accused was right. Summons were issued to four but only three were accepted and not the fourth because the person belonging to such name do not exist. Now warrant has been issued against the fourth accused and now the police is threatening another person to arrest whose father name resembles the name of father of fourth accused.
what can be done to avoid the arrest of that person?

such a problem ever i think like this..
whats the stage of the case., what about the f.i.r., error in summons only or all over the records?if charge sheet not filed mean., i think the mistake may be corrected while filing the charge sheet..
even the 4th accused should be surrender or have to pray for a,b.. otherwise he is in trouble..

A case of such type was handled by me.
I can suggest you what i have done that time.
You should approach to the court through lawyer and make a pray putting all the circumstances to call complainant in the court and ask him abt true identity of the person who is accused.

If you are for the accused fight you will get the result. You can not suffer for the mistake of the complainant and no complaint can be amended.

This query has been raised elsewhere too.
In this case, the fourth accused should move for AB, lest he be arrested when the prosecution corrects the anamoly.
