Cultural expenses mandatory by society.

(Querist) 14 October 2013 This query is : Resolved
Dear Sir,

Our cooperative housing society had made a resolution in a special general meeting, and have made it mandatory for all memebers to contribute towards cultural expenses for events such as christmas party, navratri etc.

Please advise, if the society is empowered to make such contributions compulsory vide resolutions

thanks !

the issue must have been on agenda in SGM . it must has been passed with consent of majority of members present and voting . pay the contribution sought by the society .

If your memorandum of association or bye laws allows you to make such resolutions, it is valid.

Refer bye laws of the society.

It is a game of majority. If that is a decision of majority of members in the SGM, that has to be implemented and the payment made. However, if you can muster more majority of the members of the society against the resolution, you may requisition another SGM to be called by the management and get the earlier resolution annulled.

If expenses under control, and Resolution passed by AGM, it is OK and binding.
If extravagant, or mis-managed or burdensome, can complaint to Asst Registrar/ co-op court.
