Spelling Mistake in Sale Agreement

(Querist) 12 July 2015 This query is : Resolved
In my Sale Agreement with Developer I found that there is a spelling mistake of owner, which is typed as Owmer. And ward as Nard. Will it create any problem?
Guest (Expert) 12 July 2015
It is only a Typing/Clerical Error and there should not be any Problem. For any Correction of Errors in Registered Deeds both the Parties should be Compulsorily Present in Registrar Office and Rectification Deed to be Executed as any other Registrations and presence of witnesses also Must.To my knowledge in your case there should not be any issues and Apply For EC and statements in EC regarding your Transaction would easily prove or Confirm this particular Transaction.

Thank you. So when the property will registered I will get a fresh Registered deed?
Guest (Expert) 12 July 2015
So atleast before Registration of this Go thro the documents for any correction is required.
Rajendra K Goyal (Expert) 12 July 2015
Minor mistakes.

If want correction go for registered rectification deed.
Nirmalya Mukherjee (Querist) 12 July 2015
Sir this is not a deed, this is just an agreement paper!
Dr J C Vashista (Expert) 13 July 2015
If it is not a deed and only an agreement, get it corrected executed, signed and registered in the deed.
Once deed is executed, signed and registered that is conclusive i.e., includes this agreement and no need to get a separate correction deed.
T. Kalaiselvan, Advocate (Expert) 16 July 2015
Such typo errors do occur, do not make a fuss about it, be careful with the sale deed document before getting it registered.
