Right of Hindu widow

Sir, is it Hindu widow has first (BEFORE CHILDREN) absolute right on her husband' s self earned property ? As her pre existing right of maintenance and residence . Because as per the Hindu mitakshera school or shastric law -she will rightly represent the husband as "ARDHANGINI"-and she is half sharer of the property and If she has right full possession of husband's property. So give me a guidance in this. Vijay

Sir, other wise how hindu widow get maintenance and residence ? Though their is husband's self earned property( but sons are KALYUGASONS ) how she will get husband's self earned property as absolutely before sons.?Vijay

Sir, which section of hindu successsion act prevail sec14 (1) or sec 8 for hindu widow to get the property of her husband's self earned property absolutely without giving share to her children because all are selfish and don't even take care of them in old age as well as after their (Children)marriage they are living seperatly never take any care of the parents. If sec:8 prevails then it is useless act not take the basic principles of hindu family Pl. Provide proper guidance. .vijay

Sir, husband died intestate.

If husband expired intestate, his assets would be inherited by all class- I legal heirs equally. No extra share / priority to widow.

If wife has no source of income, she can demand maintenance from son.

Whether sons are Kaliyugi or Satyugi and whether the wife is ardhangini or purnagini, Hindu succession act shall be applicable in the given situation wherein the property of deceased shall equally be divided among all legal heirs including wife and children in their individual capacity. Suppose the deceased left 4 children and one wife then the share of the wife shall only be 1/5. The concept of Ardhangini and Kaliyug putar has already been replaced by bringing Hindu code Bill by Pd. Nehru during 1955.
