Change of surname of child

I m separated from my husband and I m using my father�s surname now. I want my child to use my father�s surname also. I have the custody of my child and his father has no visitation rights. How can I change my sons surname pls guide.

The Child could use mother;s name instead of father's name which is legally acceptable. If you are particular that your father's name to be used as surname for his grand child it can not be objected.

Yes. agreed with the advise of Mr. Narasimha ji. and If your child is admitted into School with the surname of your ex-husband, then you have to submit an application to the District Magistrate of your District. After inquiry the Court issue an order and with the copy of same to the commissioner, Govt. Printing press for Gazette publication.

Sorry to point out, the question relates to surname of maternal grandfather, not the name of father or mother, as the experts seem to have misinterpreted the query.

I am of the opinion that she cannot adopt the surname of her father for her child. Only she is separated, if got divorce from her husband, but not her child from his father. Custody of child by her does not matter to get her any right to change the surname of child other than the surname of child's biological father, unless legally adopted by someone.

To my knowledge there is no Naming Act i.e a Law providing how a person ought to be named. As such, any person (or his guardian, when the child is minor) has the absolute freedom to choose any name or surname or just have a name without a surname. It is only that once a name is entered in a public record, due process needs to be followed in changing it.
