My dearest wife first runs away..files a DV on AUgust 28....has phone sex with me from her parents place ...on Dec 8th files for Divorce ...ALL OF THIS WHEN SHE IS AWAY FROM ME!
IF I PUT UP THIS CASE IN MY REPLY WILL IT NOT OR NOT DISMISS THE DIVORCE CASE?

Post a proper query what is the ground for seeking divorce?are those lines only u r defence?

DEAR MR TANGIRALA THE GROUNDS FOR DIVORCE REMAIN THE SAME AS DOM VIOLENCE. BUT SHE HAS ASKED FOR ONLY SEPERATION IN DV case then after 3 mths (while being seperated) without any provocation she has filed for Divorce and ofcourse child custody.
During these 3 mths she has phone sex with me thru SMS ....and also expresses her fear that what will happen to her future....WILL THE JUDGE TAKE COGNISANCE OF THIS FACT ?
SECONDLY, THE 2ND STEP SEEMS LIKE UNDER PRESSURE (AS HER BROTHERS ARE FILING ON HER BEHALF), WILL THE JUDGE CONSIDER THIS POINT THAT --first DV and then unprovoked DIVORCE, WILL IT GO IN MY FAVOUR??
