(Querist) 29 October 2012 This query is : Resolved 
respected,
in my case, there is no proof of legal liability against the accused.even the complainant aceepts in his cross examination that he had not filed any document to prove legal liability.
but u/s.313 accused accepted his liability and further states that he had taken handloan from complainant for which 2 cheques were given as security and after repayment of loan , despite of consistent demand , d complainant did'nt return his cheques and after 1 year of repayment , complainant misusing his cheque against him.
further i have examined him on oath and 1 defence witness who corrborates his testimony.
what's your opinion on it? please guide me.

U ARGUE OUT THE case . No Doc to prove Liability. Chq were older than 6 months,

Case in accused's fvr. After all, we , u & me , are Advocates, and after we finish, Court will decide. Wait for it.
