(Querist) 18 July 2017 This query is : Resolved 
Sir,
I have come to know your expertise through lawyerscindia.
I required your advise on following matter-
1. I am working on the post DMM. (single post in organisation)
2. my promotional post WMDO is vacant due to retirement, WMDO post is also single post in organisation.
3. initial appointment on WMDO was through initially deputation subsequently absorbed, and now he is retired from the organisation.
4. AS per recruitment rules , method of recruitment on WMDO post is promotion, direct recruitment/deputation. percentage of post not mentioned in RR.
5. i am entitled from every angle for promotion on the post of WMDO.

sir, what will be position for me in the light of reservation and other point of view. whether my right is on the post or department can do other choice to avoid me.

please guide me.

You should lodge your claim and wait for the decision of the department.

A single post in an Organisation or Department, will be filled in by promotion or direct recruitment. Now the post of WMDO is kept vacant, the department will take decision. generally, if any direct recruit is available (from selected candidates' list) then the organisation may recruit the person in the list otherwise it goes to promotee.

when the post is to be filled from multiple sources then a failing clause will be the. See RR of the post that which mode will be followed first.
