A Workman has complained before Asst. Labour Commissioner stating his transfer to other is illegal. Sirs..Can a Workman a raised this individual complaint before the Labour Court without espousal of his Trade Union. even though he is member of a Trade union. Is it admissible u/s 2k of Industrial Disputes Act. Pl advise...how to reply from management side to the Labour Court.

Individual right of a worker cannot be curbed on the plea of existence of trade union. A trade union is a facilitation mode for representation of the grievance of employees before the management, but cannot be used as a substitution of labour laws.

Yes individual workman can raise such complaint.

Labour can complain even if there is no trade union. It is their right under Labour Act.
