False evidence in dvc

(Querist) 22 February 2016 This query is : Resolved
wife filed a photograph soft copy in court as evidence against domestic violence. the date of assault mentioned in complaint is 07/04/15. by checking the properties of the image in computer it showed that it was taken on 06/09/2015 11:15AM. she didn't file photo in complaint. she wrote complaint on 27/06/15. she has submitted the hard copy in court on 11/09/2015. is this sufficient to prove that she is wilfully harassing me? another doubt is if she is ready for reunion can i impose any kind of restrictions on her by writing MoU sort of thing?

If a mediation takes place, you may take anything from her if she is willing to give that. And if you could prove her evidences as false, certainly it may amount to cruelty and you can use it in other proceeding as well. Also she will be liable to be prosecuted for perjury.

If no amicable solution possible and FIR is registered, take anticipatory bail and try for quash of the FIR.
