Fate of my marriage

Ld counsels,

Mine is a six day marriage, wife is refusing for re-union. She filed a 420 case against me and demanding lot of money. I am shocked how such a money minded people entered into my life. My relation is demaged beyond retrieval which is mainly due to my father in law. I am not willing to pay her a penny and I am ready to fight the case for years. I have filed a RCR so that I record her reason for desertion and to show that I made my attempt for re-union. My question is irrespective of the outcome of RCR can I file divorce under the grounds of desertion after 2 years. I dont think she will change her mind anytime in the future, even at that time she will say she is not ready to live with me. Will divorce be granted atleast after 2 to 3 years. I am approaching court with clean hands that is no allegations of cruelty etc will be proved against me.

Yes you can file a divorce suit after two years or you can file on the ground of cruelty after taking the permission from the court.

Dear Ranganath,

The facts mentioned by You inyour query is only "ONE SIDED".

You didn't mentioned, what is the reason and basis, or what made her to file a Case U/S.420 of IPC against you.

From the above facts, Yourself you are expressing your Intentions that:

"I dont think she will change her mind anytime in the future"

"even at that time she will say she is not ready to live with me."

Mr. Ranganath, Its a matrimonial Dispute, matter of Two Life, matter of Two families;

Did you held any sitting for conciliation ?

Did she expressed the words 'Personally' "will not change her mind" "not ready to live with you"; I think she didn't said.

So, Please try to settle amicably, with the intervention all the well wishers, family elders of both; not only for once but try as best as possible.

As per me, with concerned to this type of "Matrimonial Disputes" OR "Family Matters" there will be no solutions;

(a)If any one of the party either go to "POLICE STATION" Or "COURT".

(b) It will cause only 'Distances in Relationship' 'Break of Realationship'.

So my suggestion to avoid for further proceedings, try yourself by conciliation as per above.

Dear Mr. AEJAZ Thanks for your opinion, Invariably all lawyers of this mindset in such cases. If the other side is only demanding money and blatantly refusing for any re-union. Any conciliation attempt ends up in meaningless intimidation from the other side. Even in the RCR case the hbl judge during the fist sitting found my wife impulsive and egoistic. My wife's side is thoroughly money minded people, though it is a onesided allegations. Elders in their side distanced themselves from the matter. I am sure they will be exposed at the end of all proceedings.
