Fire cracker in class room

(Querist) 14 August 2008 This query is : Resolved 
Boy from college having age of 24 blasted fire cracker in class room, he is caught, one stuedent of age more than 18 got injured. Now tell under what sections of IPC that boy will be charged. Please answers are invited from Advocates who are having knowledge of law and who knows correct section. Vague suggestions will be ignored.

Section 285.of I.P.C. Negligent conduct with respect to fire or combustible matter


Whoever does, with fire or any combustible matter, any act so rashly or negligently as to endanger human life, or to be likely to cause hurt or injury to any other person,

Or knowingly or negligently omits to take such order with any fire or any combustible matter in his possession as is sufficient to guard against any probable danger to human life from such fire or combustible matter,

Shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.

And depending upon whether one person did this or was there abetment other provisions come into operation.

Cr.P.C.285. Commission to whom to be issued :-(1) If witness is within the territories to which this Code extend the commission shall be directed to the Chief Metropolitan Magistrate or the Chief Judicial Magistrate, as the case may be, within whose local jurisdiction the witness is to be found.

(2) If the witness is in India, but in a State or an area to which this Code does not extend, the commission, shall be directed to such Court or officer as the Central Government may, by notification, specify in this behalf.

(3) If the witness is in a country or place outside India and arrangements have been made by the Central Government with the Government of such country or place for taking the evidence of witnesses in relation to criminal matters, the commission shall be issued in such form, directed to such Court or officer, and sent to such authority for transmission as the Central Government may, by notification, prescribed in this behalf.
