heirship

(Querist) 17 May 2013 This query is : Resolved
If a person dies leaving behind his selfacquired property plus shares cf copanies. As per my knoledge his heirs has to bring succession certificate. But we can demand shares as well as immovable property in heirship certiificate only? I heard something about succession certificate also...what is that then?

1. Legal Heir Certificate is required for claiming ownership of immoveable properties. It is issued by local Tehshilder,

2. Succession certificate is required for claiming ownership of moveable properties like bank deposit amount etc. It is given by the Court.

thanks a lot sir, but here in mumbai both certificate is issued by court only then how is that?
K.K.Ganguly (Expert) 18 May 2013
May be that since there is no Tehsilder at Mumbai, Legal Heir Certificate has been arranged to be issued by the Court.

My answer was of a genaral nature with a national back drop.
