Hindu Succession Act

(Querist) 19 June 2008 This query is : Resolved 
A, a Hindu dies leaving 4 people. In his will he mentions that 100 Rs each would be paid to the 4 people he left behind i.e 400 Rs.
But after selling his property on A's death only Rs 300 is realised.
Now in what proportion would the property be divided and which Sections of which Act would apply.

well in case if the will is not specific about certain things then the intention is seen in doing that will here the intention is clear that the executer wants to give one fourth share hence the money is to be divided in that prportion only.

Atleast on thing is clear from the Will that a specific share is to be given. If the money the is less no matter but the ratio has been given. That should stand.

So one fourth of 300.
