Hon,ble Learned Advocates,
Good Morning!!
The statement of facts are given below -
1. Person read an advertisement in bus of tantric fr vashikaran and all with mobile numbers.
2. He was suffering from a problem since long.
3. He approached at given mobile number.
4. Tantric requested Rs 3500 initially, and confirmed about solution of problem with vashikaran with 48 hours.
5. Next day he said some problem is in between, so he required some more money Rs 17000 for another item.
6. The he again assured for completion of task within a day.
7. Again he showed the problem in between, further requested some amount, moving in same manner he collected Rs 320000 total in a month with different kind of assurances.
8. After a month he said due to big issue problem cant be resolved.
9. Person requsted to at least something else in recovery of money and all, at least betterment in business/service.
10. Finally he said for he cant do anything instead of prayer.
11. Person has recording of telephonic communication done at those mobile.
12. All money has been transferred with bank transaction with internet banking.
At the final note, after collecting huge money he denied.My question are -
1. Is vashikaran/Tantric acts are legal in india ?
2. In this particular case, is any legal remedy possible for this particular case ? safegaurding the person ?
3. If this is not legal, how the open advertisement is being done at buses and all ?
Kindly help in matter as subject lost huge amount..how the money can be safely recoverd.

Just lodge a FIR against tantric u/s 420, 406 of IPC.

Lodge FIR with the Police without any more delay. The tantric has cheated you.To my memory there is no law prohibiting tantric practices. Browse internet for full information on tantra and tantric practises-wikypedia. But depriving a person of his money by giving false promises constitutes cheating punishable under section 420 of the IPC.

The Author is a Member in LCI from 2010. If Any Illiterate Person had done this he could be Sympathised.Spending Rs350000/- on Tantric is a Costly Lesson.Go for Legal Remedies as Advised by Experts.

Some further information, I grabbed..The matter is 100% true as the subject has all valid evidences like recording and money transfer details.
It was some girl vashikaran matter with the objective of marriage. The subject is not illiterate. He is well educated person.The person took just a risk free approach for both.
I even dont appreciate the approach taken for marriage regarding girl. But at same side the tantric side its still a cheat.
Therefore i feel a legal action must be.Therefore after it adding this fact, what risk could involved regarding person as the way he took is not at all appreciable.
Final expert comment is requested.

It is just A Criminal Act.A Criminal had approached another Criminal To Vashikar/Hypnotise( almost)a girl.The Mission is a Failure.To recover the money a Police Complaint could be made Stating the Facts at his own Risk.

What are the punishment punishment can be directed in law ?
1. For the subject the offence has not been done, but it was planned, yes it is not a good approach..but still what maximum punishment can be planned bu judiciary ? As the girl were not vashikaran/hypnotise.
2. For the tantric the offence of cheating has been done.
What would be final comments on this point of hon'ble advocates ??
