Illegal elections ...

A regd. society is holding its elections by next week but the problem is, that the list of members from which the voters list includes lots of voters who are not entitled to vote.
Can these elections termed to be illegal.
One should complaint to which authority regarding the matter.
Can the stop the elections or appoint his own election officer.

Can these elections termed to be illegal.

Can the Registrar stop the elections or appoint his own election officer.

Lodge complaint with registrar and it may declare it illegal.

the byelaws provide that The managing committee shall appoint one Returning Officer (RO) from amongst the non-contesting members who has given his consent that he will neither propose nor second any candidature

the society must have appointed returning officer for elections . complain to the RO regarding electroal rolls

I had duly sent an application to the Election Officer which was acknowledged by the Returning Officer stating that before i contest the elections i would like to clarify certain clarifications to the memberships /the Bye laws/eligibility of voters but he answered to me in person stating that preparing the voters list and your queries regarding the eligibility of membership is the duty of the Office bearers and not his and we have forwarded the letter to the Office Bearers.He never answered this in written to me.
The office bearers have received my letter but never have answered to my application too and now i have not been able to exert my right of elections as the last date of filing of the nomination is over now.
Now what should i do.

Have you not meet the Election officer or the returning officer who had acknowledge your letter

Yes i have met them but they have told me that we have forwarded your letter to the Managing Committee as they are answerable to the issue of membership and voters list.

But if the Managing Committee also has not answered my letter and they have continued on with irregular list of members, what should be done now.

Should i send another letter to the Managing Commitee now.

You should now make a written complaint to the registrar of your area and should also seek his intervention in the whole issue immediately and even take over the charge of such society in its hands as the same is not working as per rules.

If our letters to the Registrar are delayed due to procedural delays and the results of such illegal elections are announced , will these elections termed as legal.

If we complain to the Registrar after the elections will the have some diff. implications though we are not going to be part of the election process both as candidates and voters.
