inheritance of property

Querist : Anonymous (Querist) 11 November 2009 This query is : Resolved
I am one and only daughter of my parents. My father has inherited some property from my grandfather in the year 1988.My late father has three brothers. The yougest one looked after the property of my father. After my father's expiry my self and my mother asked the uncle to give our shares. He is insulting us and telling that he will not give and cheating us for the last 7 years. Incidentally he is also a lawyer.
My questions are
1.How to get back my property?
2.How much expense I have to incur to get the property back
3. Can he booked for cheating?
Manish Singh (Expert) 11 November 2009
you are the true legal successor/heir of the property along with your mother so file a suit for possession. in tersm of expenses, its nt possible to predict. dont delay and file the suit as soon as possible.
no case of cheating would be made out under the circumstances stated above.

1) File a SUIT FOR PARTITION on the property of left by your grandfather.

2) Expence will be depends upon lawyer fees.

3) No there is no case of cheating in this.

I have no different opinion than of Sachin and Manish. Take immediate steps as suggested.
