Last year I was caught smoking hookah in a bar. The police took me to police station entered my name and address in the register and made me sign a document took a fine of ₹200 and left me I was not told to come to court or anything. There was no arrest. Now I am about to go to US and have to apply for passport and visa. My question is will this small issue show up as a criminal history in the government database ? I didn't know hookah was banned in mumbai. Will there be a problem in background checks when I apply for a job ? Also will this offence come up on police clearance certificate ? I have learnt my lesson and not smoked since that incident. Please help I'm in a dilemma

Please ascertain that why you had been arrested and later bailed out and also I believe convicted since you had perhaps signed a bail bond for being booked in a petty offence. I do not think that it would be an impediment in going to USA. You can use RTI Act for knowing the fact. I am sure that your arrest had not been shown from Hookkah bar but from any public place for disorderly conduct in public place.

What is the document you had signed? What does the receipt for the amount show - is it fine? Anyhow, such petty offence may not be of any adverse effect.

Thank you for your replies. I had not been arrested. It was just a 200 rupee fine. The matter was compounded then and there. The police gave me a fin r form no 1 challan and wrote COTPA act on it. I was not summoned to court or anything. Also was I convicted or just charged and later acquitted when I paid the amount. Will this offence show up on police clearance certificate.

Plz reply. Also I was never arrested I just went to police station in the rickshaw on my own and I paid the compounding fee that's it. There was no jail time involved.

Fine is also conviction. When the receipt was granted it must be fine. I don't think it will affect your visa or visit prospects to US.
