Is reckless driving conviction ineligible for grade a government jobs

(Querist) 12 October 2013 This query is : Resolved
Sir,

I want to apply for Grade A central govt. jobs and state government jobs. But I was arrested and charged with drunk driving but reduced to reckless driving conviction in the USA in 2010. There was no property damage or no harm to people.

Will I be ineligible for govt jobs in india (Group-1 services, UPSC etc.) when the character and antecedent verification is done and while submitting the character certificate?
Raj Kumar Makkad (Expert) 12 October 2013
The conviction in USA just against a reckless driving is not a hurdle in getting Govt. job in India.
Devajyoti Barman (Expert) 12 October 2013
It does not involve activity of moral turpitude. Hence such conviction is no restraint to get Govt. Job.
prabhakar singh (Expert) 12 October 2013
You need not worry for that kind of a conviction as that would NOT create any bar for jobs you are aspiring for.

No hurdle in getting Govt. job in India.

U.s.a. trail process is nither adopted nor applicable in India. No effect on govt.job
Sudhir Kumar, Advocate (Expert) 12 October 2013
first of all be clear that the rules of character antecedents verification are same for all posts. So candidate for Gp-A post is not on different footing.

Not able to agree or agree to the experts.

I will add that how do you respond the questionnaire in attestation form which clearly asks.

Have you ever been convicted by any court of law? if yes give details.
Ms.Nirmala P.Rao (Expert) 13 October 2013
Unless, it is a very serious crime such as an offence involving moral turpitude, depravity, or reckless driving resulting in death of persons etc normally government of India do not prohibit persons convicted of petty offences and if your conviction results in acquittal preferably on merits etc and you are held not guilty of of rape, murder and other serious offfences etc you'd get Government jobs.

Please press the Thank you button on my profile if you wish to thank me for my reply as above.

Even if one is convicted a fine of 1 rupee for a theft,it would be a conviction for an offence involving moral turpitude while a conviction for murder in many circumstances may not be.
Mohan (Querist) 14 October 2013
Sudhir sir hit the nail on its head. I am confused how to answer that question precisely.

Have you ever been convicted by any court of law? if yes give details.
Anirudh (Expert) 14 October 2013
Every conviction does not involve moral turpitude. Therefore the Applicant has to give the complete details of his conviction in the Application Form. However, I am quite sure that the said conviction in the present case will not be a bar for appointment to any Government service.
Raj Kumar Makkad (Expert) 14 October 2013
I do agree with Anirudh that every offence is not a moral turpitude and thus the said conviction is not bar to get job in India.
Rajendra K Goyal (Expert) 23 October 2013
Well advised, nothing more to add.
