Is this forgery or cheating by impersonation?

(Querist) 03 January 2013 This query is : Resolved
Respected Legal Experts,

While I was out of country, my wife’s father(a retired Law College Principal), without my consent or power, obtained patta for my land on my name. He concealed this fact and deceived me to sign power of attorney for my land. He claims I have to pay him for obtaining patta for my land.
Questions are:
1. Did he commit forgery or cheating by impersonation when he obtained patta?
2. Is the deliberate concealment of patta at the time of signing power of attorney, considered deception/cheating?
3. Am I expected to pay him?

Please advice.

Thanks.

You have stated that you have signed a power of attorney for your land. So, it all depends upon the contents of your power of attorney you gave to your father-in-law.

Hope you would have read the contents of your power of attorney carefully before signing that.

first part of your case facts resembles to a precedent that is 'Dr Vimla vs delhi administration case 1962 SC' and it is not cheating or forgery by personation.

For answering your second and third question your facts of your query falls short. it depend upon the facts mentioned in the POA.
