Jurisdiction

Guest (Querist) 05 August 2013 This query is : Resolved
for case of dv and maintenance lawyer says to put in from panchkula although her parents living in chd. as of no information they say yes and paid lawyer 10000/- rupees for that. now when they consult others all are saying that jurisdiction of girl comes under chd only.
1. Can she put case in panchkula or not although she is living with parents in chd?

2. on consulting others lawyer denied to put case in chd and saying their is no case of jurisdiction so put case in panchkula?

3. if the case cannot be put in panchkula and as lawyer is denying to put case in jurisdiction then do lawyer refund the amount(if yes then through whom consult bar council or directly) as he is not ready to put case in chd?

1. The case can be filed form either of the places.
2. It is upto you since both the places have jurisdiction.
3.If no work is done then the advocate should return at least par of it.
