Landlord bullying pagdi tenants and not allowing a peaceful co-existance

(Querist) 16 November 2013 This query is : Resolved
Hi Sir,

We are residing in a pagdi system flat in Mumbai since past 50 years and we are facing the below mentioned problems.

1) About 10 years back the original landlord sold off the land-lordship along with the Ground + 1st floor to someone else. And the new landlords (two friends have acquired it)have recently started bullying us by not allowing us to park our bikes.
2) They keep switching off our electric meter as they have easy access to the common meter box (they occupy the ground +1 space).
3) They are now using this space for religious get to gathers for their community and that makes it very difficult for our family members to use the staircase as there is a too much of crowding each day of the week. Also, they all put their shoes on the staircase which makes it very risky for people to use the staircase. specially the elders.
Another question I have is, do we need to just inform the landlord OR take his permission to make changes to our house like adding an extra toilet as we have a spacious flat.I am planning to add an english style toilet for my ailing parents. I am sure they will not allow me to do it if i ask their permission.

Please do advise me as i am in a desperate situation and this is the only property i have and the only roof on my family's head.

Please keep this conversation private if possible.

Kindest Regards.
Juanita

Dear Author
you describe your problem that is daily life problem as i understand there is no legal problem so you talk with land lord politely, other wise you consult local police station or lawyer to solve your problem.

you cannot make any structural changes in flat without landlord consent . if you want to construct english style toilet or make any alterations in flat do obtain landlord consent .

It seems that the new landlord is trying his best to oust the tenants.
Agree for structural changes the consent of land lord is essential. Ask the permission orally and then in writing.

If non- cooperative attitude of the new landlord continues, contact a local lawyer.
