Leakage from Upper Floor Flat

Our upper floor flat owner is not repairing his toilate seepage to my flat.we have informed to upper floor flat owner and also society committee 2 mths back but nobody has taken action till now and construction of building is not permitted by govt. Kindly advice the legal action that we can take�

Send lawyer legal notice to owner of said flat to do repairs within 15 days so that leakage is stopped.
