There is a leakage of water from the bath room and latrine from flat
Above my flat. Despite several requests, the owner of flat above me is not getting their bath room and latrine repaired. Owner of flat is not cooperating for getting repairs done even at my cost. Requested Flat Owners Association but Association also fails.
The Flat Owners Association (forms in the year 2003-2004) is not registered with the competent authority of state Of Gujarat.
What is the legal remedy for me? OR
Can Un-registered Association take action either legally or forcefully on the flat owners?
I am Residing in GUJARAT STATE.
Please advise me I am Thankfull to You Sir.

you will have to move court and obtain an order directing your neighbour to repair his bathroom . offer to pay 50%costs of repairs

First of all engage a local lawyer dealing in civil side and then serve a legal notice to your neighbour followed by a civil suit for mandatory injunction and damages. Get appointed a local commission in that case and do obtain the desired relief with suitable damages.
